1. Scope
These Terms and Conditions ("Terms") apply to all services provided by People Pulse GbR ("Company") to clients ("Client"). By engaging our services, the Client agrees to these Terms.
2. Services
People Pulse GbR offers HR-as-a-Service (HR-AAS) solutions. Detailed descriptions of our services are available on our website.
3. Formation of Contract
A contract is formed when the Client accepts a proposal or offer provided by the Company, either in writing or electronically.
4. Prices and Payment
Pricing: All prices are net and do not include statutory value-added tax (VAT) or other applicable taxes.
Payment Terms: Invoices are payable within 14 days of receipt, unless otherwise agreed upon.
Default: In case of late payment, the Company reserves the right to charge default interest as permitted by law.
5. Client Obligations
The Client agrees to provide all necessary information and cooperation required for the Company to perform the agreed services.
6. Cancellation and Refunds
Cancellation: The Client may cancel services by providing written notice. Cancellations made less than 14 days before the agreed start date may incur a cancellation fee of up to 50% of the service fee.
Refunds: Refunds are evaluated on a case-by-case basis.
7. Liability
The Company is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is excluded, except for damages resulting from injury to life, body, or health.
8. Confidentiality
Both parties agree to keep confidential any proprietary information received from the other party during the course of the contract.
9. Data Protection
The Company processes personal data in accordance with its Privacy Policy, which complies with applicable data protection laws.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany.
11. Amendments
The Company reserves the right to amend these Terms at any time. Clients will be notified of significant changes in writing.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
